Acceptance of Terms

By using newdawnlandscapingnj.com or engaging New Dawn Landscaping & Land Design (“New Dawn”) for services, you agree to these terms.

Service Description

New Dawn provides landscape architecture, hardscape installation, lawn care and property maintenance, snow operations, and drainage services across Mercer County, NJ and adjacent Central New Jersey communities.

Estimates and Quotes

Free consults, walk-throughs, and verbal estimates are non-binding. A signed written service agreement governs the actual scope of work, pricing, schedule, and liability for any engaged project.

Service Agreements Govern Specific Work

For any retained service, including maintenance contracts, hardscape installations, drainage projects, and snow operations, the signed service agreement provided to the client governs the specific scope, pricing, schedule, exclusions, property access, and liability terms. Where these website terms conflict with a signed service agreement, the signed agreement controls.

Payment Terms

Payment terms vary by project type and are detailed in each signed service agreement. Standard structures include deposit-on-signing, progress payments tied to project milestones, and balance due on completion. Late payments may incur fees as detailed in the signed agreement.

Cancellation Policy

Cancellation terms are detailed in each signed service agreement. We respect clients’ right to cancel and will refund unearned deposits per the terms of the specific agreement.

Property Access and Liability

By engaging New Dawn for services, the property owner or authorized representative grants access for the agreed scope of work. Liability terms, including for snow operations, hardscape work, and drainage installation, are governed by the signed service agreement and our maintained insurance coverage. Certificate of Insurance and additional-insured language available upon request for HOA, commercial, and corporate clients.

Intellectual Property

Landscape design plans, site analyses, and renderings produced by New Dawn remain our intellectual property until full payment for the design is received, after which usage rights are transferred per the signed agreement. Photographs of completed work may be used by New Dawn for portfolio and marketing purposes unless the signed agreement specifies otherwise.

Limitation of Liability

To the maximum extent permitted by law, New Dawn’s total liability for any claim arising from website use is limited to one hundred dollars (USD). Liability arising from contracted services is governed by the relevant signed service agreement and our insurance coverage.

Governing Law

These terms are governed by the laws of the State of New Jersey. Any disputes shall be resolved in the courts of Mercer County, NJ.
